It presents the catalogue of products marketed under the Atmosphera Créateur d'Intérieur® trademark to internet users browsing the website. It is also possible to access the list of the distributor stores and to find the geolocation of the nearest store.
The prices that may be indicated on the Website are recommended retail prices. The price charged by your store may therefore differ from the price indicated on the Website.
Photos in the Atmosphera Créateur d'Intérieur® catalogue and in general any photos published on the Website are not contractual. 2. INTELLECTUAL PROPERTY

a) Atmosphera Créateur d'intérieur® trademarks and

JJA is the owner of the French and Community trademarks:

"Atmosphera Créateur d'intérieur®"
 as well as the domain name "atmosphera.com".

The company DEPOT BINGO is the beneficiary of a licence for the Web to use the trademarks "Atmosphera créateur d'intérieur", hereinafter "Atmosphera®" and the domain name "atmosphera.com", of which JJA is the owner.

Any use of the names " Atmosphera " or " Atmosphera créateur d'intérieur " or of the logo to designate identical or similar products on any medium whatsoever is strictly forbidden and would constitute an infringement of the trademarks of the owner company as provided for and sanctioned by articles L.713-2 et seq., L.716-1 et seq. and L.717-1 et seq. of the French Intellectual Property Code.

Article L.716-9 of the French Intellectual Property Code states that:
"Any person who, with a view to selling, supplying, offering for sale or renting goods presented under a infringing trademark, shall be punished by four years' imprisonment and a fine of 400,000 euros:
a) Importing, exporting, re-exporting or transhipping goods presented under a infringing trademark;
b) Industrially producing goods presented under a infringing trademark (...);


Article L.716-10 of the same Code provides that:
It is punishable by three years' imprisonment and a fine of 300,000 euros for any person to:

a) hold without legitimate reason, import or export goods presented under an infringing trademark;
b)  offer for sale or sell goods presented under an infringing trademark; (...)
 

b). Intellectual property rights attached to the presentation, the content of the Website and its images

The Website, its presentation and its content, both the texts and all photographs are protected by the provisions of the French Intellectual Property Code, including under copyright law by Articles L.122-1 et seq. of the French Intellectual Property Code:

The Website, its presentation, its content and all its photos and images are and shall remain the exclusive property of JJA, which alone is entitled to use and exploit the intellectual property rights and personality rights attached to the Website, including any drawings and models, copyrights and image rights, on an original basis or by virtue of an assignment or exploitation licence.

Pursuant to the French Intellectual Property Code and, more generally, any international treaties and agreements containing provisions relating to the protection of copyright, the visitor is prohibited, in whole or in part, from reproducing, downloading, selling, distributing, issuing, disseminating, adapting, modifying, publishing or communicating, in any form whatsoever and on any medium whatsoever, the presentation, organisation or content of the Website, including any of the photographs.

Any violation of the rights and obligations listed above would constitute an infringement of the intellectual property rights of the companies JJA and DEPOT BINGO as provided for and sanctioned by articles L.331-1 et seq. and articles L.335-1 et seq. of the French Intellectual Property Code.

Access to all or part of the Website may be suspended or removed by simple decision of DEPOT BINGO in the event of force majeure, computer or technical difficulties, difficulties linked to the structure of the telecommunications networks, blocking of the telecommunications networks, strikes, national or local states of emergency, bad weather, etc., without this list being exhaustive.
